Outdated Gun Ban in Kooskia Sparks ISAA Action

The Idaho Second Amendment Alliance has formally notified the town of Kooskia that its firearm ordinance violates Idaho’s state preemption law.

For nearly 12 years, ISAA has led the charge to eliminate illegal local gun restrictions across the state. Thanks to our efforts, over 90 violations—ranging from unlawful signage to outdated codes—have been corrected in cities and counties statewide.

During a recent review of municipal codes, we discovered that Kooskia’s ordinance, listed under Section 5-1-9, is out of compliance with Idaho Code § 18-3302J. The ordinance dates back to 1959 and contains two issues:

🔹 Section 5-1-9(B)(1) criminalizes the concealed carry of pistols, revolvers, and other weapons. This blanket prohibition is a clear violation of state law and must be repealed.

🔹 Section 5-1-9(B)(2) bans all firearm discharge within city limits, with an exception only for law enforcement. While cities may regulate the discharge of firearms, Idaho law requires exemptions for lawful self-defense and sport shooting ranges—exemptions that Kooskia’s code currently lacks.

Many Idaho towns have already updated similar ordinances to comply with the law. We’ve asked Kooskia officials to notify us of any changes so we can keep gun owners informed. We’ve also offered to assist in rewriting the ordinance if needed.

Broke their ordinance once or twice driving through town, guess I won’t visit their city or businesses again.
