Labrador & Knudsen Lead Charge Against Magazine Ban Ruling

Idaho Attorney General Raúl Labrador and Montana Attorney General Austin Knudsen filed an amicus brief to defend the Second Amendment.

Twenty-six Attorneys General joined with the Arizona Legislature in filing an amicus brief urging the United States Supreme Court to safeguard citizens’ right to possess standard-capacity firearm magazines, commonly referred to as “plus-ten magazines.”

The filing comes in the case of Gator’s Custom Guns, Inc. v. Washington, which challenges Washington State’s ban on magazines holding more than ten rounds. While a lower court struck down the ban, the Washington Supreme Court reinstated it; now Gator’s Custom Guns is asking the Supreme Court to reconsider.

The Attorneys General and the Arizona Legislature argue that “plus-ten magazines” are essential components of modern arms and are protected by the Second Amendment. They say that history and tradition support Americans owning these magazines for lawful purposes, including self-defense, and that the Washington Supreme Court failed to show its ruling complies with the standard of the Supreme Court’s landmark Bruen decision (2022), which requires firearm restrictions to align with the nation’s historical tradition of gun regulation.

Attorney General Austin Knudsen said, “The Supreme Court needs to step in to uphold Americans’ right to keep and bear arms. Lower courts, including the Washington Supreme Court, are attempting to attack and rewrite the Second Amendment. Law-abiding citizens should not be treated like criminals for exercising their constitutional rights.”

Idaho Attorney General Raúl Labrador added, “California and Washington courts are attempting to rewrite the Second Amendment by claiming the Constitution does not protect firearm magazines at all. Such rulings would allow anti-gun states to ban virtually any firearm component by declaring the Constitution irrelevant. We are asking the Supreme Court to reject this infringement and ensure law-abiding citizens can defend their families.”

Twenty-six states joined, Montana, Idaho, Alabama, Alaska, Arkansas, Florida, Georgia, Iowa, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, and Wyoming, together with the Arizona Legislatureur, urging the Court to reverse the Washington Supreme Court’s ruling.

Being united, these states are clear on their message: restrictions on standard-capacity magazines are an unconstitutional infringement on the Second Amendment, and citizens’ rights will be defended at the nation’s highest Court.
