Firearm preemption issues have happened across Idaho. We’ve helped fight nearly 100 of them.
This time, the spotlight is on Kooskia, where an outdated ordinance dating back to 1959 criminalizes concealed carry and bans all firearm discharge within city limits—even for lawful self-defense. Both provisions directly violate Idaho Code § 18-3302J, which prohibits local governments from enacting firearm regulations stricter than state law. ISAA formally notified Kooskia officials and offered assistance in rewriting the ordinance to bring it into compliance.
Meanwhile, in Eagle, a similar issue has emerged with signage and local codes that overstep legal boundaries. These kinds of violations—whether intentional or simply outdated—create confusion for gun owners and undermine the uniform protections guaranteed under Idaho’s preemption statute.
